Professional Liability Adjusters Insurance - IMPORTANT NOTICE

Amendments to the Insurance Agents & Adjusters Regulation were passed into law April 11, 2001, making these minimum requirements mandatory for residents and non-residents.

Under Section 385(5.1) of The Insurance Act of Manitoba and Section 16 of the Insurance Agents & Adjusters Regulation state all licensed adjusters must at minimum, maintain professional liability insurance in the amount of $1,000,000 in respect of any one occurrence with an overall policy aggregate of at least $1,000,000.

The policy will also include such elements as; coverage amounts that are exclusive of defense and investigative expenses; coverage for the insured's supervisory activities, if applicable and any unlicensed employee for whose acts the insured is responsible;  and shall not be restricted to particular insurer's products.  The coverage will include an extended reporting for a period of 12 months, and will include extended coverage for errors or omissions that were made before the inception of the insurance, provided that the errors and omissions were made on or after July 1, 2001 and the insured had no knowledge of the claims before the inception of the insurance.

You will be required to provide proof satisfactory to the Insurance Council of the existence of this policy when you are renewing your licence. The adjusters licence applications, including renewal applications, shall also require that the adjuster attest to having errors and omissions insurance in force, which is in compliance with this section, and that he or she shall immediately cease acting as an adjuster if such insurance ceases to be in force.

Pursuant to Section 385(8.1) of The Insurance Act of Manitoba, no licensed insurance adjuster shall carry on the activities of an insurance adjuster while he or she is not insured under a policy of liability insurance that meets the requirements of 385(5.1).

In addition, Section 385(8.2) of The Insurance Act of Manitoba states, a licensed insurance adjuster whose liability insurance lapses, or is cancelled by the adjuster or the insurer, shall notify THE INSURANCE COUNCIL OF MANITOBA without delay.

Who Must Provide a Criminal Record Check (CRC)?

Criminal Record Checks (CRCs) are only valid for six (6) months from the date of issue.

Individuals seeking a General, Life, A&S, or Adjuster Insurance Licence must provide an original criminal record check (CRC) if the person applying is a resident of Manitoba AND falls into one of the following categories:  


- the person has never held a licence with Council; OR
- the person has not held a General, Life, A&S, or Adjuster licence with Council within the past year; OR
- the person’s criminal history has changed since they last applied for a licence with Council.

If the criminal record check lists a possible match or conviction(s), the applicant or licensee is required to provide a criminal record check by fingerprints which would detail the possible match or conviction(s).  

For applicants residing outside of Manitoba, see information below.

Individuals who are submitting applications to renew or transfer a licence are not required to obtain CRCs unless, since the date of the last application, the individual has been convicted of a criminal offence, has pending criminal charges, has received a Conditional or Absolute Discharge, or if the individual has been requested by Council to submit one. If the criminal record check lists a possible match or conviction(s), the licensee or former licensee is required to provide a criminal record check by fingerprints which would detail the possible match or conviction(s).


When completing your licence application, ensure you read the application instructions carefully, as you must still disclose your criminal record and details on the application form.

How to Apply for a Criminal Record Check (CRC)

The Insurance Council of Manitoba (ICM) is now accepting CRCs issued through Sterling Backcheck only when accessed through the Insurance Council of Manitoba’s landing page with Sterling Backcheck.

Two Important Notes:

Criminal records checks issued through Backcheck MUST be accessed through the ICM’s landing page here to ensure it includes the correct Manitoba requirements. The CRC issued through the ICM’s landing page will include results from both the “Canadian Criminal Record Check” database and the “Local Police Information” database. Checks not issued through the ICM’s landing page link will not be accepted as they will not include results from both databases.

Checks issued through Backcheck when accessed through the ICM’s landing page will cost an applicant $30.00, as opposed to a cost of approximately $59.00 when obtaining a CRC through a different channel in the Backcheck webpage.


CRCs are not acceptable when issued through any other third-party provider. 

 

Residents of Winnipeg: Checks can be completed through one of the below:

  • Option 1: Winnipeg City Police Service - The Winnipeg Police Service offers residents of Winnipeg the ability to use an automated online system for submitting Police Information Checks called ePIC. ePIC(the electronic Police Information Check online system) allows applicants to apply online to submit their applications 24/7 from any location direct to the ICM. There is no paperwork required by applicants, and applicants can monitor the status of their application at any time through their own personal account.  Visit www.winnipeg.ca/police for more information and how to apply.

  • Option 2: Sterling BackcheckApplicants must use the ICM landing page to obtain their CRC from Backcheck (aka: myBackCheck.com). This must include results from both the Canadian Criminal Record Check and the Local Police Information check. A check submitted to the ICM without local police information results would not be accepted. Refer to the two important notes above in red.


Residents of rural Manitoba: Checks can be completed through one of the below:

  • Option 1: Local RCMP Detachment – Contact your local RCMP detachment in advance of your visit to determine if their location is open to the public, and to determine the processing requirements, cost of the service, and hours the service is available in your jurisdiction. 

  • Option 2: Sterling BackcheckApplicants must use the ICM landing page to obtain their CRC from Backcheck (aka: myBackCheck.com). This must include results from both the Canadian Criminal Record Check and the Local Police Information check. A check submitted to the ICM without local police information results would not be accepted. Refer to the two important notes above in red.

 

Residents of other Canadian Provinces:  Because residents from outside of Manitoba must be licensed in their resident jurisdiction in order to apply for a Manitoba licence, a CRC is not required unless the applicant has been convicted of a criminal offence, has pending criminal charges, has received a Conditional or Absolute Discharge, or if the applicant has been requested by Council to submit one.

 

Residents of the United States: Residents of the United States are required to obtain two separate CRCs from: 1) The Federal Bureau of Investigations (FBI); and 2) the applicant’s home State police department.  Note:  CRCs cannot be completed through a third-party provider, therefore, they are only acceptable to ICM when they are completed directly through the FBI and your State police department.  If the search indicates a criminal record may or may not exist, Council requires an original criminal record "printout" also known as a "Certified Criminal Record Check" (this is different from an initial CRC). Fingerprints would be required by the agency to complete this process.

Independent Insurance Adjuster Licensing Procedures

New Adjuster Licensing Rules came into effect January 1, 2024 and are available on the ICM website - Licensing Rules.

Any person holding an adjuster's licence is required to comply with The Insurance Act of Manitoba, the Insurance Adjuster's Licensing Rules, the Regulations and the Adjuster's Code of Conduct.

Applicants whereby an examination is required can contact the Council's office at (204) 988-6800 to arrange a date and time. 

The following defines the restrictions and/or authorizations and requirements to obtain and maintain each level of licence.

Level 1 Assistant Adjuster

Must be sponsored and employed by an adjusting firm.

Must successfully complete one of the following:

- C11 (Principles and Practice of Insurance), or
- C81 and C82 (General Insurance Essentials), or
- A written examination set by Council (pass mark 75%), or
- The ILS Level 1 General and Adjuster Insurance Licence Program (ILS L1).

Must be supervised by a supervising adjuster who has held a Level 2 or Level 3 Adjuster licence for a continuous period of at least three years immediately before becoming the supervising adjuster.

Must provide to council a fully completed Supervision Agreement.

Prohibited from: managing an office of an adjusting firm; supervising an adjuster or assistant adjuster licensed under these rules; signing any reports or correspondence unless the report or correspondence has been reviewed by an individual holding a Level 2 or Level 3 Adjuster licence; and acting as the designated representative of an adjusting firm.


Level 2 Adjuster

Must hold or be eligible to hold a Level 1 Assistant Adjuster licence.

Must successfully complete the following Insurance Institute of Canada courses:

- C11 (Principles and Practice of Insurance), and
- C12 (Insurance on Property), and
- any one of the following: C15 (Loss Adjustment and Claims Settlement), C17 (Claims 1), C110 (Essentials of Loss Adjusting), and
- any one of the following: C13 (Insurance Against Liability - Part 1), C14 (Automobile Insurance - Part 1), C111 (Advanced Loss Adjusting), C112 (Practical Issues in Claims Management).

Must have been employed as an assistant adjuster or adjuster, or worked under contract as an adjuster, in a multiline general insurance company or adjusting firm for a cumulative total of at least two years within the five-year period immediately before the day the application is made.

Must be sponsored by an adjusting firm and is either employed by or works under contract for the firm.

May act as the supervising adjuster of the holder of a Level 1 Assistant Adjuster licence.

May manage an office of an adjusting firm.

Prohibited from: acting as the designated representative of an adjusting firm.


Level 3 Adjuster

Must hold or be eligible to hold a Level 2 Adjuster licence.

Must successfully complete the following Insurance Institute of Canada courses:

- C32 (Bodily Injury Claims), and
- any one of the following: C46 (Claims 2), C41 (Property Loss Adjustment), C111 (Advanced Loss Adjusting), and
- C112 (Practical Issues in Claims Management).

Must have attained the Chartered Insurance Professional (CIP) Designation from the Insurance Institute of Canada.

Must be employed as an adjuster, or worked under contract as an adjuster, in a multiline general insurance company or an adjusting firm for a cumulative total of at least five years within the 10-year period immediately before the day the application is made.

Must be sponsored by an adjusting firm and is either employed by or works under contract for that firm.

May act as the supervising adjuster of the holder of a Level 1 Assistant Adjuster licence.

May manage an office of an adjusting firm.

May act as the designated representative of an adjusting firm.


Adjusting Firm Licence

A sole proprietorship, partnership or corporation is eligible for an adjusting firm licence if it:

- provides the council with evidence of registration with the Companies Office of the Government of Manitoba;
- operates in a physical location that is separate from any financial institution or insurance company;
- does not hold itself out to the public, including on the Internet, as being part of any financial institution or insurance company;
- carries on business separately from any financial institution or insurance company;
- employs at least one adjuster as the adjusting firm's designated representative;
- employs or engages at least one adjuster holding a Level 2 or Level 3 adjuster licence to manage each branch office other than the office at which the designated representative is located;
- employs or engages at least one adjuster holding a Level 2 or Level 3 adjuster licence to supervise individuals holding Level 1 assistant adjuster licences in each branch office at which an individual holding a Level 1 assistant adjuster licence is located; and
- provides the council with the name and current contact information of the designated representative and each adjuster who supervises an individual holding a Level 1 assistant adjuster licence.

A sole proprietorship, partnership or corporation that operates in one or more jurisdictions outside Manitoba must provide the council with evidence of good standing in each jurisdiction in which it operates to be eligible for an adjusting firm licence.

A designated representative is responsible for the management and operations of the adjusting firm and must hold a Level 3 adjuster licence.

An adjusting firm must advise the council as soon as practicable of any change to the identity or contact information of the firm's designated representative; or any adjuster responsible for supervising an individual holding a Level 1 assistant adjuster licence at the firm.



Additional Licensing Information

Pursuant to Section 371(2) of the Insurance Act of Manitoba, the completion of an application and passing of a written examination does not guarantee the issue of a licence. Each applicant must first be found suitable to hold a licence.

Manitoba's licensing year for independent insurance adjusters runs from July 1 to June 30, and licence fees are not prorated.

Adjusters must accumulate eight (8) hours of continuing education annually between July 1 and June 30. More information on continuing education can be found here.

Education and/or Examination Information

To apply for a General Insurance Agent licence, you must complete one of the three four-page application forms and submit this form along with proof of completion of one of the below courses. If you are applying to write an examination, you are required to supply the Examination Registration Form along with the examination fee. (NOTE: the examination fee is $110.00 payable by cash, money order or company cheque only).  Incomplete Examination Registration Forms and/or Application Forms will be returned without review.

Education and/or Examination to obtain a Level 1 Auto Only Broker Licence
  • successfully completes the following:
  • the Auto Broker Technical Course through IBAM; and
  • the Manitoba Public Insurance proficiency examination.

Education and/or Examination to obtain a Level 1 General Agent Licence
  • successfully completes one of the following:
    • CAIB 1 through IBAM; or
    • Fundamentals of Insurance through IBAM;
    • Introduction to General Insurance through ILS; or
    • Council's Challenge Level 1 Examination.
      • consists of 100 multiple choice questions
      • 75% is the required pass mark
      • time allotment is 2 hours.

Education and/or Examination to obtain a Level 2 General Agent Licence
  • completes CAIB 1, Fundamentals of Insurance or currently holds a licence as a Level 1 General agent and successfully completes one of the following:
    • CAIB 2 and CAIB 3 through IBAM; or
    • Council's Challenge Level 2 Examination
      • consists of 100 multiple choice questions
      • 75% is the required pass mark
      • time allotment is 2 hours.

or

  • has any one of the following designations: C.I.P., A.I.I.C., F.C.I.P., F.I.I.C., C.A.I.B., C.I.B., and C.R.M. or another designation that the council considers equivalent.

Education and/or Examination to obtain a Level 3 General Agent Licence
  • has carried on business under the Level 2 licence for a period of at least two years and who
    • successfully completes one of the following:
      • CAIB 4 through IBAM; or
      • Council's Challenge Level 3 Examination
        • consists of 150 multiple choice questions
        • 75% is the required pass mark
        • time allotment is 3 hours.

or

  • Another designation that the council considers equivalent.
